Portable Basketball Hoops on Colonial Court

Dear Resident of Highgate OA:

Recently, several portable basketball hoops have been placed on Colonial Court. Some nearby homeowners raised concerns that these structures may violate the Declaration of Covenants and requested that the Board review the situation. Due to ambiguities in the Covenants, the Board sought legal advice from the association's attorney.

The attorney’s conclusions are as follows: 

1. Temporary Structures: The basketball hoops are considered temporary structures as defined by the Covenants and are therefore not permitted to be left in the Common Areas or within residents’ yards. 

[Article VI, Section 1(i) of the Declaration states: "(i) Temporary Structure. No structure of a temporary character shall be maintained upon any Lot or upon the Common Areas at any time. Outdoor clothes dryers or clotheslines shall not be maintained upon any of the Lots or the Common Areas at any time..."]

2. Storage: When not in use, the hoops should be stored in a garage. 
3. Usage: When in use, the hoops should be placed on the resident’s driveway. Since the HOA owns and is responsible for Colonial Court, ensuring the safety of children requires that the hoops not be placed on Common Areas or in the street. 

Additionally, the Board acknowledges concerns expressed by several homeowners regarding the safety of children playing in the street. Although the HOA is not responsible for policing Colonial Court, it has installed three speed bumps and multiple signs to help slow traffic. The Board encourages parents and older children to remain vigilant and supervise younger children while they are playing.
